Welcome to Black Creek Lodge! These Terms and Conditions govern your use of our website (www.blackcreeklodgeny.com) and the booking and use of our vacation rental property. By accessing our website or booking a stay at Black Creek Lodge, you agree to these Terms and Conditions.

1. Booking and Payment

Reservation Process: All bookings are made through our website and managed via OwnerRez. Once you select your dates and complete the booking form, a confirmation email will be sent.
Payment: Payments are processed securely through Stripe.
Security Deposit: A refundable security deposit of $500 or a non-refundable $35 damage waiver is required to cover potential damages. If you chose the deposit option, a temporary hold will be placed on the booker's credit card and refunded within 14 days after checkout, provided no damage is reported (minus transaction fees from Stripe).

2. Cancellation Policy

Guest Cancellations:
- All reservations are non-refundable
Owner Cancellations:
- In rare cases where we must cancel your booking (e.g., due to property damage or emergencies), you will receive a full refund.

3. Check-In and Check-Out

Check-In: After 4pm
Check-Out: By 11:00 AM
Self-Check-In: Check-in details, including smart lock access codes, will be provided 12 hours before arrival.

4. House Rules

To ensure a pleasant stay for all guests and to protect the property, we kindly ask you to follow these house rules:

Maximum Occupancy: 10 guests
No Smoking: Smoking is not allowed inside or outside the property. A cleaning fee of $200 will be charged if this rule is violated.
Pet Policy: No pets allowed.
Noise Policy: Please respect quiet hours between 10 PM - 8 AM.
Use of Amenities:
- Guests may use the hot tub, firepit, game room, and other amenities at their own risk.
- Proper supervision is required for children using the amenities.
Firewood and Charcoal: Available for purchase or guests can bring their own.
Trash Removal: Please dispose of trash in the designated outdoor bins before checkout.

5. Liability and Safety

Assumption of Risk: By booking and staying at Black Creek Lodge, guests assume all risks associated with the use of the property and amenities, including but not limited to the hot tub, firepit, and creek.
Injury and Damage: We are not responsible for any injuries, accidents, or damages that occur during your stay. Guests are liable for any damage caused to the property or its contents.
Natural Elements: Black Creek Lodge is located in a natural setting. Guests may encounter wildlife or insects. We perform regular pest control, but cannot guarantee a pest-free environment.

6. Privacy Policy

Your privacy is important to us. Please review our Privacy Policy for information on how we collect, use, and protect your personal data.

7. Intellectual Property

All content on our website, including text, images, logos, and videos, is the property of Black Creek Lodge and is protected by copyright laws. Unauthorized use or reproduction is prohibited.

8. Force Majeure

We are not responsible for delays, cancellations, or damages caused by events beyond our control, including but not limited to natural disasters, severe weather, pandemics, or power outages.

9. Dispute Resolution

Any disputes arising from these Terms and Conditions or your stay at Black Creek Lodge will be governed by the laws of the State of New York. Disputes will first be attempted to be resolved amicably. If an agreement cannot be reached, disputes will be handled through mediation or arbitration in New York City.

10. Changes to Terms and Conditions

We reserve the right to update these Terms and Conditions at any time. Any changes will be posted on our website, and your continued use of our services constitutes acceptance of the revised terms.
